Terms of Service

These Terms of Service ("Agreement") are a legal agreement between you ("you", "your", or "Customer") and IntelliHost, LLC ("we," "our," or "IntelliHost"), the owner and operator of www.intellihost.co, revenue-iq.ai, and affiliated platforms (collectively, the "Sites"). This Agreement governs your access to and use of the Sites and your purchase of products or subscriptions made available through the Sites, including IntelliHost and Revenue IQ services.

By accessing or using the Sites, or by purchasing a product or subscription, you represent that you are at least 18 years of age. If you are under 18 but at least 13 years old, you may only use the Sites with the consent of your parent or legal guardian. If you are a parent or guardian and provide consent for a minor to use our Sites, you agree to be bound by this Agreement on their behalf and to assume full responsibility for the minor’s compliance. If you do not agree, you may not use the Sites or purchase any products or services.

1. Changes to the Site; Personal Information; Privacy

1.1 Changes to the Site

We reserve the right to update, modify, or discontinue any part of the Sites at any time without prior notice. This includes, without limitation, any content, features, or services.

1.2 Personal Information

You agree to provide accurate, current, and complete information for both self-serve and non-self-serve purchases. We reserve the right to suspend or terminate accounts where information is found to be false or misleading. We use a third-party payment processor to handle all financial transactions.

1.3 Privacy, Data Usage, and Compliance

By using our Sites, you consent to the use and collection of your data in accordance with our Privacy Policy. Additionally, if you register or subscribe using a corporate email address, you authorize IntelliHost to display your company name and/or logo in its customer listings or marketing materials, unless you explicitly request otherwise in writing in accordance with our Privacy Policy, which is incorporated into this Agreement. This includes data collected automatically via cookies, browser fingerprinting, and analytics tools such as Google Analytics and Facebook Insights. You agree that your information may be transferred and processed in the United States and other jurisdictions where IntelliHost operates.

We comply with applicable data protection laws, including the California Consumer Privacy Act (CCPA) and, where relevant, the General Data Protection Regulation (GDPR). We and our third-party service providers may use automated tools such as cookies, web beacons, canvas fingerprinting, and browser fingerprinting to collect technical data including, but not limited to: browser and device type, operating system, screen resolution, time zone, language preferences, installed graphics hardware, referring URLs, timestamps of visits, site navigation behavior, and general location information. These methods help us prevent fraud, enhance user security, and improve site performance and services. For a detailed explanation of how your data is handled, please review our Privacy Policy.

In addition to optimizing performance and personalizing services, we may also process and aggregate user data—including listing information, calendar availability, performance metrics, and user interactions—to conduct internal market research and generate anonymized industry reports and insights. These research outputs do not identify individuals or properties and are used to advance understanding of market trends, pricing strategies, and STR performance across regions.

If you submit calendar data (iCals) or property information, you grant IntelliHost a non-revocable license to use this data to power, improve, and personalize its optimization systems.

2. Passwords; Site Use; Prohibited Conduct

2.1 Passwords and Account Security

You are responsible for maintaining the confidentiality of your account credentials. If you access the Sites through third-party services (such as Facebook, Google, or LinkedIn), you acknowledge that your use of those services is governed by their own terms and privacy policies. We are not responsible for any actions or data handling practices of third-party platforms. If you become aware of unauthorized use, you must notify us immediately.

2.2 Prohibited Conduct

You agree not to:

Interfere with or disrupt site functionality.

Use bots or automated scraping tools.

Copy or reverse engineer our software.

Use the Sites for unlawful purposes.

Violations may result in immediate termination of access.

2.3 Chat Sessions

Our customer service agents reserve the right to refuse or terminate chat sessions due to abusive or inappropriate conduct. Agents will never ask for sensitive financial data.

3. Terms of Sale

3.1 Sale to End Users

All purchases are intended for your personal or internal business use and may not be resold unless explicitly agreed to in writing.

3.2 API Usage

Select customers may receive access to our API, subject to license terms and use restrictions. Derivative works created using the API must attribute IntelliHost appropriately. Free trials are available for internal testing only and may not be used for production or commercial purposes.

3.3 Fees and Billing

You agree to pay all applicable fees as outlined at the time of purchase or in your data agreement. Unpaid overages may result in service suspension. Monthly minimum charges apply unless otherwise agreed.

3.4 Service Continuity

While we aim for consistent uptime, we do not guarantee uninterrupted access. We are not liable for downtime, bugs, or data inaccuracies.

3.5 Cancellations and Refunds

Refunds are not offered for algorithmic or digital products unless required by law. Cancellations must occur before renewal deadlines. Self-serve subscriptions may be canceled online or by contacting support. Non-self-serve cancellations require 3 business days’ notice before billing renewal. Early termination by customers may result in charges for the remaining contracted amount.

4. Intellectual Property

All content and software on the Sites are owned by IntelliHost or its licensors. No rights are granted except as explicitly outlined. Unauthorized use or reproduction is prohibited.

5. Submissions

Unsolicited ideas, including new products, features, or services, submitted to IntelliHost become our property without compensation or confidentiality.

6. Third-Party Links and Indemnity

6.1 External Sites

Links to external websites are provided for convenience. We are not responsible for their content or practices.

6.2 Indemnification

You agree to indemnify and hold harmless IntelliHost and its affiliates from any claims resulting from your misuse of the Sites or breach of this Agreement.

7. Disclaimers

Our services, including Revenue IQ and IntelliHost tools, are provided "as is" without warranties of any kind. We do not guarantee specific outcomes, rankings, or revenue increases. You use our tools at your own risk.

8. Limitation of Liability

While we strive to deliver high-performance optimization, certain elements are outside our control, including:

Changes to Airbnb or third-party platforms

Market fluctuations

External software integrations

Let’s keep this clear. While we work diligently to help your listings perform, IntelliHost does not control the platforms you list on, such as Airbnb, Vrbo, or others. These platforms may change their algorithms, policies, or suspend listings at their discretion. As such, we are not liable for indirect or consequential damages arising from actions taken by third-party platforms, market changes, or external integrations outside our control.

If we are found liable, our total cumulative liability shall not exceed the amount paid by you in the last 90 days or $100—whichever is greater.

We expressly disclaim fiduciary obligations. You are responsible for evaluating and implementing our recommendations.

9. Arbitration and Dispute Resolution

9.1 Arbitration Agreement

Disputes that cannot be resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). You waive the right to jury trials and class actions.

9.2 Opt-Out Rights

You may opt out of arbitration by notifying us in writing within 30 days of your first purchase.

9.3 Jurisdiction

For any litigation permitted under this Agreement, jurisdiction is agreed to be Utah County, Utah.

9.4 Choice of Law

This Agreement is governed by U.S. federal law and the laws of the State of Utah.

10. General Terms

We may update or revise this Agreement at any time. Continued use of our services indicates your agreement to the changes.

This Agreement, including our Privacy Policy, constitutes the entire agreement between you and IntelliHost. Any failure to enforce a provision is not a waiver. If any part is held unenforceable, the remainder remains in effect.
